Dream House Productions, Inc. (DHP) is solely responsible for the selection of participants for the 2008 season of the Pauper to Princess reality show.
YOU MUST AGREE TO THE TERMS & CONDITIONS TO SUBMIT YOUR APPLICATION
1. I am about to complete and submit my Application to DHP to be considered in the preliminary stage of selection of Housemates for the 2008 season of Pauper to Princess.
2. I understand that submitting my Application does not mean I will proceed to the next stage of the selection process and I acknowledge that DHP has no obligation to select me as a Housemate for Pauper to Princess.
3. I acknowledge that DHP is entitled to exclude me from participating at any stage of the selection process at its sole discretion without providing any explanation or reason to me.
Eligibility:
4. At the time of submitting my Application, I warrant that:
(a) I have completed the Application form by myself and that no other person has completed the answers for me;
(b) I am 18 years or older;
(c) I am an US citizen or have been a permanent resident US for at least two years;
(d) I am not and, to the best of my knowledge, no member of my *immediate family or anyone living at my residential address is, an employee, officer, director or agent of DHP or any of their affiliated organizations;
(e) if I or any member of my immediate family or anyone living at my residential address becomes an employee, officer, director or agent of DHP or any of their affiliated organizations, I will inform DHP immediately by telephone or e-mail or certified mail
*"Immediate Family" means spouse, defector spouse, parent, or step parent, natural or adopted child or stepchild and sibling (whether natural or adopted by a parent), uncle, aunt, nephew or niece whether or not they live in the same household as you.
8. I acknowledge that DHP have no obligation to use or make available my Application or Video to any person. I understand that DHP may at any time for any reason remove (in whole or in part) my Video or any information I have provided in connection with my Application from the Pauper to Princess website, including if DHP (in its sole discretion) determines that I have breached or are likely to be in breach of any of these Terms & Conditions (including any warranty).
Other stages of the selection process
9. I understand DHP may (but is not obliged) to invite me to participate in further stages of the selection process, including by asking me to:
(a) complete a detailed questionnaire ("Questionnaire") in which I will be required to provide answers about my background, family, relationships, medical history, any criminal convictions (other than spent convictions) and other matters which DHP considers necessary to determine my suitability to participate in Pauper to Princess;
(b) undergo medical, psychological and criminal checks as DHP considers necessary to determine my suitability to participate in Pauper to Princess; and
(c) attend an audition or auditions with representatives of DHP for the purpose of selecting Housemates for Pauper to Princess ("Audition").
10. I acknowledge that submitting my Application and participating in any further stages of the selection process, including any Audition, does not constitute my entry into a relationship or association of any kind with DHP and I will not receive any payment for that participation.
11. I warrant that the information and answers I provide in my Application, the Questionnaire and otherwise to DHP in the course of participating in the selection process will be true and correct to the best of my knowledge and belief. I acknowledge that if DHP discovers that the information or answers I have provided are false or misleading and I have been chosen to be a Pauper to Princess Housemate, I may be immediately disqualified by DHP from participating in Pauper to Princess and will be ineligible for any prize.
12. I understand that I am not obliged to complete the Questionnaire or undertake the tests and checks described above but that my failure to do so may render me ineligible to participate in any further part of the selection process for Pauper to Princess (but in which case these Terms & Conditions will continue to apply to me).
Assignment of Rights
13. In consideration of DHP agreeing to consider my Application, I assign to DHP all rights (including present and future copyright) subsisting in my Video, the contents of my completed Application and, if applicable, my answers to the Questionnaire and in any other copyrights works that I create as part of my participation in the selection process for Pauper to Princess ("Materials").
14. In return for my assignment of rights in the Materials, DHP consents to me retaining a copy of the Materials for my personal use on condition that I do not directly or through any other person offer to sell, hire, distribute, reproduce or otherwise use or authorize the use of the Materials for any commercial purpose or provide a copy of those Materials (or any part of them) to any other media organization, outlet or platform without DHP's express consent.
15. I acknowledge that the Materials may be edited, cut, summarized or otherwise revised or modified at DHP's absolute discretion for use in any way in any media for Pauper to Princess or in connection with the promotion and publicity of Pauper to Princess.
Recording and Release
16. I agree that DHP may record and reproduce on film, tape, photograph and by any other means my name, likeness, voice and appearance as taken from the Materials and from my participation in an Audition (in each case a "Recording").
17. I acknowledge that DHP may use each Recording (in whole or in part):
(a) to show other persons for the purpose of deciding whether I should be chosen to participate in Pauper to Princess; and
(b) in Pauper to Princess itself and for publicity and promotion of Pauper to Princess in any way in any media without further consent from me or any payment to me and regardless of whether I am selected to participate in Pauper to Princess.
I agree that DHP is not obliged to credit me in Pauper to Princess or in any advertising or promotion of Pauper to Princess for any of this use.
18. I understand DHP will own copyright in the Recording and may edit the Recording in any way and may synchronize the audio from the Recording with other visual images and the vision from the Recording with other audio.
19. I agree that I may not make any claim or application to a court of law or tribunal with respect to the use of the Recording by DHP according to these Terms & Conditions and that this paragraph is fundamental to my being permitted to participate in application process for Pauper to Princess.20. I agree to participate in the selection process voluntarily and at my own risk. I agree that DHP and DHP will not be liable to me for any loss or damage or injury to me, my property or my reputation caused or suffered in connection with the making and use of the Recording or my attendance at an Audition or my travel to and from an Audition. To the maximum extent permitted by law, I hold and will continue to hold DHP harmless in relation to any such injury loss or damage.
My availability
21. I understand that if I am contacted and invited to proceed to an Audition, I must be available to attend in early 2008 and that I will be advised of the relevant date closer to that time.

23. I acknowledge that if I am chosen to attend an Audition, I may be required to sign a further confidentiality undertaking and a release in relation to the filming of my Audition and the statements made during my Audition.
24. I understand that if I am chosen to be a Pauper to Princess Housemate, I will be required to:
(a) travel to and remain in the Pauper to Princess House for up to the whole period of broadcast of Pauper to Princess in the first half of 2008 and that I will be advised of the dates closer to that time;
(b) enter into a detailed contract with DHP covering all aspects of my participation in Pauper to Princess and also to enter into a management contract with DHP (or DHP's agent) to manage my public and media activities for a period after I leave the Pauper to Princess House; and
(c) comply with the rules of Pauper to Princess, including the rules by which Housemates are bound during their stay in the House as notified to me by or at the direction of DHP.
Confidentiality
25. I acknowledge that it is essential to DHP that all information about the selection process and auditions for Pauper to Princess which is generally not available to the public is to be kept absolutely confidential. I understand that I may obtain information about the selection and audition process, the production of Pauper to Princess and its publicity and promotion, the people who have applied to participate in auditions and about the business of DHP that is not generally available to the public. This is all "Confidential Information".
26. I promise that at all times (unless otherwise required by law), I will keep the Confidential Information secret and confidential, I will not use the Confidential Information for any purpose and I will not disclose the Confidential Information to any other person or allow or make it possible for any other person to see any of that Confidential Information ("Confidentiality Undertaking").
27. As part of my Confidentiality Undertaking, I promise that I will not make any statement or give any interview about my participation in the selection process or any Audition or Pauper to Princess to any media person or form of media outlet without the prior written consent of DHP regardless of whether I am selected as a participant in Pauper to Princess.
28. If I breach my Confidentiality Undertaking, I understand that I could cause serious financial and other loss to DHP and that DHP may take legal action to claim damages for that loss or to prevent me from breaching my Confidentiality Undertaking.
Privacy Statement29. I understand that DHP is bound by the Privacy Act 1988 in respect of my personal information. I consent to DHP collecting my personal information for the primary purpose of selecting participants for Pauper to Princess and that it may share my personal information with each of its affiliated companies and respective employees and subcontractors to a level that is necessary to enable them to perform their roles in relation to these purposes, provided those persons are obliged to respect the confidentiality of my personal information.
30. I consent to DHP making the following information in my Application available to the public:
(a) my first name;
(b) the State or Territory in which I reside;
(c) my age and gender;
(d) my occupation;
(e) my relationship status;
(f) my hair and eye colour; and
(f) the description and views of myself which I provide on my Application form.
I acknowledge that this information may be made available to users of the Pauper to Princess website to register views and ratings (on a scale of 1 to 5) of my suitability and/or popularity as a potential Housemate and also for broadcast and the promotion and publicity of "Pauper to Princess" in any way in any media and I consent to all such use.
31. I understand that DHP will not, without my consent, disclose my surname, residential address (other than the State in which I reside) or the other personal information I have provided on my Application form (except the information listed in the paragraph immediately above). I acknowledge that DHP will not be in breach of this obligation in relation to any information about me which:
(a) I choose to disclose during the course of the filming and recording of Pauper to Princess (if I am chosen as a Housemate); or
(b) is already available to the public or is disclosed by any third party not under the direct control or direction of DHP.
32. I agree that DHP may retain my personal information as part of a record of individuals who have applied to be participants for Pauper to Princess and use that information to contact me to inquire whether I wish to appear as a participant on Pauper to Princess or other television programs produced by Dream House Productions or DHP and to send me information and offers about those programs.
I understand that I may submit a request for access to a copy of my Application and that DHP reserves the right to impose a reasonable charge for processing and collating personal information, where appropriate and permitted under the Privacy Act 1988.
I understand it is my decision to accept these Terms & Conditions and that by accepting and submitting my Application I promise that I have read and understood these Terms & Conditions including the Privacy Statement.
